Supreme Court Provides Relief in Human Rights Case

Islamabad: The Honourable Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry took notice on an application of Sheikh Nadeem Hussain, Advocate, Member Sadiqabad Bar Association District Rahimyar Khan regarding recovery of abductee Asghar Ali Chaudhry, Advocate and arrest of nominated accused. After taking the notice, the report was called from PPO Punjab and PPO Balochistan.

In compliance with the above directions, the PPO Balochistan and PPO Punjab submitted their reports intimating therein that efforts are being made to trace out the abductee and special team under the supervision of Superintendent of Police Rahimyar Khan has been constituted with the directions to make all the efforts to effect the arrest of accused Abdul Qahir and recovery of abductee at the earliest.

After going through the reports, the Honourable Chief Justice of Pakistan passed the order that PPO Punjab and Chief Secretary Balochistan be directed to ensure recovery of abductee in co-ordination with relevant Authorities of the two Provinces without further delay and keep on sending fortnightly progress reports to this Court till recovery of the abductee.

After that, the PPO Punjab submitted his report that “during course of investigation, it transpired that the civil suits between the parties are also subjudice in different courts. However, a special team has been constituted under the supervision of SP (Investigation) with the direction to make all out efforts to effect the arrest of accused Abdul Qahir Khan and recovery of Asghar Ali Chaudhry, advocate at the earliest.

A special team has been sent to Quetta , Balochistan and Karachi for recovery of abductee and arrest of accused. A request has been made to Govt. of the Punjab, Home Department, Lahore to make a move to Home Department, Govt. of the Balochistan for provision of assistance for recovery of abductee and arrest of accused.

Home department, Govt. of the Punjab, Lahore has been asked to move Ministry of Interior, Government of Pakistan, Islamabad to place name of accused on Exit Control List (ECL). Efforts are afoot to affect the arrest of accused person and recovery of abductee at the earliest. No stone will be left unturned”.

After the report of PPO Punjab, the Honourable Chief Justice of Pakistan further directed that copy of application and reports submitted by PPO Punjab and direction already passed by his lordship be forwarded to Secretary Interior to ensure that request made by the PPO Punjab be attended to properly and report in this regard be submitted within 15 days.

Finally, PPO Punjab reported that “as per report of DPO Rahimyar Khan, Mr. Asghar Ali Chaudhry, Advocate the abductee has been recovered.”

After perusal of the above report, the Honourable Chief Justice of Pakistan has been pleased to pass the order that “the application be filed and applicant be informed”.
