Supreme Court issues notice to attorney general in constitution petition no. 2 of 2012

Islamabad: A three member bench headed by the Hon’ble Mr. Justice Nasir-ul-Mulk and comprising on Hon’ble Mr. Justice Sarmad Jalal Osmany and Hon’ble Mr. Justice Gulzar Ahmed heard the Constitution Petition 2 of 2012 Hafiz Ubaid Ullah Zakria Vs.

Federation of Pakistan through Secretary Establishment, (challenging the Office Memorandum No. 1/15/92-CP-II dated 4th October, 2011 regarding allocation of 10% posts of Deputy Secretaries for lateral induction from other Services groups, Provincials Services and retired military officers. The Bench passed the following order.

“Notice be given to the respondents as well as to the Attorney General for Pakistan in view of the Office Memorandum No. 1/15/92-CP-II dated 4th October, 2011 regarding reservation of 10% of the sanction post of the Deputy Secretaries for employees of the autonomous, semi-autonomous body or corporation etc.

and another 10% of annual vacancies of Deputy Secretary BS-19 for retired officers of the armed forces as such reservation affects the petitioner’s opportunities of promotion. 2. A concise statement shall also be filed by the respondent No.1 and 2 within a fortnight and the petition be fixed for hearing in the week thereafter”.
