Supreme Court Hears Criminal Original Petition No. 06 Of 2012 In Suo Moto Case No. 4 OF 2010

Islamabad: A seven member bench headed by the Honourable Mr. Justice Nasir-ul-Mulk, and comprising other six members namely Honourable Mr. Justice Asif Saeed Khan Khosa, Honourable Mr. Justice Sarmad Jalal Osmany, Honourable Mr. Justice Ejaz Afzal Khan, Honourable Mr. Justice Ijaz Ahmed Chaudhry, Honourable Mr. Justice Gulzar Ahmed and Honourable Mr. Justice Muhammad Ather Saeed heard Criminal Original Petition No. 06 of 2012 in Suo Moto Case No. 04 of 2010 (Contempt proceedings against Syed Yousaf Raza Gillani, the Prime Minister of Pakistan in compliance with this Court’s order dated 16.01.2012) and other connected cases.

Moula Bakhsh Chandio, Federal Minister for Law, Moulvi Anwar-ul-Haq, Attorney General for Pakistan, Mr. Dil Muhammad Alizai, DAG, Mr. Shaiq Usmani, Sr. ASC, Mr. K. K. Agha, PG, NAB, Mr. Fowzi Zafar, ADPG and Mr. Akbar Tarar, APG appeared in the Court. Mr. Aitzaz Ahsan, Sr. ASC appeared in Criminal Original Petition No. 06/2012, while Mr. M. Azam Khan, Director (Legal) appeared on behalf of FIA. The bench heard the case on 02.02.2012 (Thursday) and passed following order:-

“We had issued notice to Syed Yousaf Raza Gillani, the Prime Minister of Pakistan on 16.01.2012 under section 17(1) of Ordinance V of 2003 to show cause as to why the proceedings of contempt of court may not be initiated against him for not complying with the direction of this Court given in Paragraph 178 of the judgment in “Dr. Mobashir Hassan v Federation of Pakistan (PLD 2010 SC 265)”. In response, the Prime Minister appeared and addressed the Court briefly.

Barrister Aitzaz Ahsan, learned Sr. ASC appearing for the respondent, was granted preliminary hearing in terms of Section 17(3) of the said Ordinance. Upon hearing the arguments, we, prima facie, are satisfied that it is in the interest of justice that we shall proceed further in the matter. Accordingly, the case is adjourned to 13.02.2012 for framing of charge against the Respondent. He shall be present on the date fixed.

Rest of the matters will also be taken up for hearing on the date i.e.13.02.2012.”
