Supreme Court allows C.M. Appeal.05/2012

Islamabad: A three member bench headed by the Hon’ble Mr. Justice Iftikhar Muhammad Chaudhary, Chief Justice of Pakistan and comprising other two members namely Hon’ble Mr. Justice Khilji Arif Hussain and Hon’ble Mr.Justice Tariq Parvez heard the Civil Misc. Appeal No. 05/2012, Ruhaifa Vs. Federation of Pakistan (Against the order of the Registrar of this Court returning the Constitution Petition being not entertain able).

The Constitution Petition has been filed under Article 184 (3) of the Constitution wherein it was stated that three sons of the petitioner namely Syed Abdus Saboor, Syed Abdul Basit and Syed Abdul Majid along with other 8 detenues are in the illegal confinement of the Respondents since 29.05.2010 and out of them three have been killed in an unlawful manner and without any trial and due process of law.

Attorney General for Pakistan and Director (Legal) Ministry of Defence appeared on behalf of the Federation while Mr. Tariq Asad, ASC represented the petitioner.

C. M. Appeal was allowed, office was directed to entertain the Constitutional Petition and fixed for 30.01.2012. Notices to Attorney General for Pakistan, Advocate General KPK and respondents were also ordered to be issued.
