Srinagar, March 21, 2013 (PPI-OT): In occupied Kashmir, APHC leader and Chairman of Jammu and Kashmir National Front, Nayeem Ahmad Khan was re-arrested soon after he was released on court directions.Nayeem Khan, who was arrested on March 8, 2013, in a false case registered against him by Indian authorities in Police Station, Pattan, was released on court orders on Wednesday but was re-arrested soon after his release from Srinagar Central Jail,” said a spokesman of the National Front in a statement.
The Judicial Magistrate, Pattan while hearing the case said police charge-sheet cannot survive and as such the court has option to discharge Nayeem Ahmad Khan of all the charges levelled against him u/s 13 of the Unlawful Activities Act.
An FIR was lodged on 11-01-2000 in Police Station Pattan against Khan for allegedly instigating people against Government of India (GoI). The court dropped all the charges against Khan saying the content of words in charge-sheet are neither quoted nor cited, which would have enabled the court to form an opinion whether the words amounted to instigation, prejudicial to the interest of the government or to integrity or sovereignty of India. “There is no other evidence on record to substantiate the charges u/s 13 of U L Act,” the court observed.
It said the court has no option but to discharge the case for the charges leveled against him. He should be released from custody as he is no more required by this court in the instant case,” the judgement reads. Khan’s lawyer Rafiq Ahmad Joo said he submitted the court orders to jail officials of Central Jail, Srinagar. “They released Khan but he was re-arrested under some unknown case,” he said.
