Islamabad, March 04, 2013 (PPI-OT): The Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry took notice on an office note initiated by the Registrar, Supreme Court of Pakistan based on press clippings of different newspapers containing the details of the carnage where at least 45 people died and 150 injured in a huge explosion that ripped through a Shia-majority neighborhood called Abbas Town in Karachi on 03-03-2013. Several women and children were among the victims.
Further, after the explosion, the members of the Shia-community took to the streets against the law enforcement agencies and the Government, demanding arrest of the killers. Mourners gathered at different places and set a bus ablaze on MA Jinnah Road . The situation in many areas is tense.
It was further reported that the law enforcement agencies and other government officials did not reach the venue of the blast in time for the rescue operation, due to their presence in a private function as they were busy there to provide security/protocol to higher-ups.
The note further intimated that soon in the aftermath of, and following the pattern of two consecutive bomb blasts in Quetta , Balochistan, this equally shocking carnage should serve as an eye-opener. The incidents at Quetta led to the sacking of the Provincial Government, with calls also made for replacement of civil administration by the Armed Forces, to provide security to inhabitants. It being a major disaster, causing 45 deaths and 150 wounded with enormous loss/destruction to property, is a serious violation of fundamental rights, guaranteed under Articles 9, 14, 23 and 24 of the Constitution.
Taking notice of the incident the Hon’ble Chief Justice of Pakistan, Mr. Justice Iftikhar Muhammad Chaudhry passed the following order:-
“Instant note be treated as CMA in Suo Moto Case No. 16/2011 (Law & order situation in Karachi ) and put up in Court on 06-03-2013 at Karachi. Advocate General and PPO, Sindh be directed to file comprehensive report as prima facie it appears that State/Provincial Government has failed to protect life and property of citizens, therefore, appropriate order after hearing to all concerned is required to be passed.”
