Full Court meeting of Supreme Court Islamabad held

Islamabad, April 18, 2013 (PPI-OT): A Full Court meeting was held today (18-04-2013) in the Supreme Court of Pakistan, Islamabad under the chairmanship of the Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry and was attended by Hon’ble Mr. Justice Tassaduq Hussain Jillani, Hon’ble Mr. Justice Nasir-ul-Mulk, Hon’ble Mr. Justice Jawwad S. Khawaja, Hon’ble Mr. Justice Anwar Zaheer Jamali, Hon’ble Mr. Justice Khilji Arif Hussain, Hon’ble Mr. Justice Mian Saqib Nisar, Hon’ble Mr. Justice Asif Saeed Khan Khosa, Hon’ble Mr. Justice Sarmad Jalal Osmany, Hon’ble Mr. Justice Amir Hani Muslim, Hon’ble Mr. Justice Ejaz Afzal Khan, Hon’ble Mr. Justice Ijaz Ahmed Chaudhry, Hon’ble Mr. Justice Gulzar Ahmed, Hon’ble Mr. Justice Muhammad Ather Saeed, Hon’ble Mr. Justice Sh. Azmat Saeed and Hon’ble Mr. Justice Iqbal Hameedur Rahman. Dr. Faqir Hussain, Registrar, Supreme Court of Pakistan also attended the meeting.

At the beginning of the meeting, the Hon’ble Chief Justice of Pakistan welcomed the Hon’ble Judges specially Hon’ble Mr. Justice Iqbal Hameedur Rahman who has recently been elevated as Judge Supreme Court of Pakistan and was participating in the Full Court meeting for the first time. Hon’ble Chief Justice said that the purpose of the meeting is to take stock of the performance of the Supreme Court in terms of dispensation of justice and disposal of cases for redressal of grievances of the litigants.

The Hon’ble Chief Justice of Pakistan also acknowledged and appreciated the efforts and commitments of the Hon’ble Judges for their hardworking aimed at diminishing backlog in order to provide quick justice to litigants and redress the grievances of aggrieved persons. He further told that it is the duty of the judiciary to ensure the supremacy of constitution and rule of law in the country.

The civil society, lawyers and litigants have trust in judiciary, therefore, they refer their disputes/cases for resolution and justice before it. The institution of cases is increasing day by day not only on regular side but also on human rights side which shows the increasing trust of public in the institution of judiciary.

The Full Court meeting considered pendency and disposal of cases and suggested ways and means to provide speedy relief to litigants. It was emphasized that benches were also constituted at Branch Registries at Lahore, Karachi, Peshawar and Quetta where the Hon’ble Judges worked and performed judicial functions and made tremendous efforts for disposal of cases.

Talking on the point of disposal of cases, his lordship added that number of cases instituted in this Court has increased but now due to the efforts and commitment of all the Hon’ble Judges, the ratio has reduced, for which he was grateful to all his brother Judges for doing extraordinary work in the best interest of justice and institution.

The Full Court discussed the institution and disposal of cases during the period from 09-2-2013 to 12-04-2013 and expressed its satisfaction as 3950 cases have been disposed of whereas 3738 cases were instituted during the said period.

Considering the menace of frivolous litigation, it was decided that false and frivolous litigation should be discouraged and Benches seized of the matter should impose cost upon the party whose case is found to be frivolous or vexatious.

It was also decided that adjournments should be discouraged except in unavoidable circumstance and further cost should be imposed for the same. As far as practicable the application for restoration of a petition/appeal dismissed in default shall be fixed before the same Bench which has passed the earlier order for its dismissal in default, and if it was not possible due to some reason then before a Bench in which an Hon’ble Judge is a member who was also a member in the earlier Bench which had dismissed the petition in default. Further, cost should be imposed in such cases.

The Full Court was also briefed about the arrangements made for the International Judicial Conference 2013 scheduled from 19th to 21st April 2013, which is a regular annual judicial event to share experiences and to evolve strategies for resolution of issues faced by the judicial system. Hon’ble Mr. Justice Tassaduq Hussain Jillani, Senior Judge, Supreme Court of Pakistan also apprised the Full Court in detail about the arrangements, participations of international delegates, thematic groups etc. He expressed that this will greatly help us in formulating innovative strategies for reforming judicial system in the country and making it responsive to the present-day requirements of the society.
