Delimitation – No such powers have been given to Election Commission of Pakistan

Islamabad, October 03, 2014 (PPI-OT): A news item has appeared in a section of press stating that “The KPK Government has empowered the Election Commission of Pakistan (ECP), through an amendment so that it (ECP) could make delimitation” which is not correct.

In this regard, the Election Commission clarifies that no such powers has, so far, been given to the Election Commission of Pakistan.

Section 10 of the Khyber Pakhtunkhwa Local Government Act, 2013, that is about “Delimitation Authority and Principles of Delimitation” clearly says that “Government shall, by notification in the official Gazette, constitute a Delimitation Authority for delimitation of village councils, neighbourhood councils and territorial wards for general seats to Tehsil, town and as, the case may be, District Councils”.

The KPK Government has already constituted a Delimitation Authority under the Chairmanship of Secretary Local Government, KPK which has completed the delimitation and final notification has already been issued on 10th March 2014.

Furthermore, as per Rule 13 of the Khyber Pakhtunkhwa Local Councils (Conduct of Elections) Rules, 2014, the Government of KPK is required to place a formal request to the Election Commission for conduct of elections but the same has not been placed so far.
